On September 30, 2015, the National University of Life and Environmental Sciences of Ukraine (NUBEU) accepted the bid of UKRAINE CONSTRUCTION AND DESIGN FIRM LLC for a major overhaul of the academic building following a tender held on September 16, 2015. The cost of the work was UAH 13,799,448.00.
A total of seven companies took part in the competitive bidding: SMART-BUD LLC, RESEARCH AND PRODUCTION FIRM DIAMOND LLC, CONSTRUCTION AND DESIGN FIRM UKRAINE LLC, Construction Company Avtorembudservis LLC, EDELWEISS PLES LLC, City Bud LLC, and I.B.K. LLC.
The lowest bid was offered by SMART-BUD LLC at UAH 12,838,912.00, which was UAH 960,536.00 less than the winning bidder. The most advantageous bid was rejected due to a number of minor circumstances, including the lack of certificates from the registry of persons who have committed corruption offenses and the absence of any prosecutions against the bidder's representatives for crimes committed with mercenary motives; a discrepancy in the number and date of the order approving the anti-corruption program; the company's outstanding unified social contribution of UAH 64; and the failure to provide copies of feedback letters.
As follows from the above, the customer rejected the most advantageous offer on formal grounds, neglecting the opportunity to save budget funds in the amount of UAH 960,536.00.
To prevent the loss of public funds, the Rule of Law public organization appealed to the competent authorities of Kyiv, as well as to the customer of the tender, demanding that they conduct an investigation into illegal activities, hold those responsible accountable, and terminate the dubious contract.
