The Anti-Corruption Court considered and applied a preventive measure in the form of detention to the former head of the fiscal service.
The High Anti-Corruption Court ordered the detention of former Chairman of the State Fiscal Service Roman Nasirov, whom the NABU and SAPO suspect of receiving UAH 722 million in unlawful benefits from oligarch Oleh Bakhmatyuk for VAT refunds to his companies.
This decision was made on October 31 by the investigative judge of the High Anti-Corruption Court, Natalia Movchan, reports “Word and deed».
«The NABU detective's motion is granted in part. The suspect, Roman Nasirov, is to be remanded in custody. The detention order is to be extended until December 17." the judge announced.
The court ordered Nasirov to pay an alternative of UAH 523,205,865. If he posts bail, he will be released from the pretrial detention center under the following obligations: report when called upon; not leave Kyiv without permission; report any change of residence; and refrain from communicating with the suspected oligarch. Oleg Bakhmatyuk and other persons specified in the order; to hand over for safekeeping their foreign passports, service passports and other documents for travel abroad, and to wear an electronic bracelet.
Why did the VAKS arrest Nasirov?

The investigation established that the head of the State Fiscal Service (2015-2016) received an improper benefit of $5,5 million for ensuring the reimbursement of over UAH 540 million to companies within the agroholding in August 2015 and over EUR 21 million for the reimbursement of nearly EUR 2,7 billion in VAT between February and August 2016. Nasirov received the "service fee," which averaged approximately 20% of the reimbursed VAT, into the account of a foreign company under his control, as well as a company controlled by his father-in-law and advisor, through another foreign shell company recruited by the former official's advisor. The sender of the funds, as established by NABU and SAPO, was a non-resident company controlled by Bakhmatyuk, the owner of the agroholding.
Moreover, part of the unlawful benefit was generated directly from budget VAT refunds and converted into foreign currency. NABU and SAPO have evidence that the head of the State Fiscal Service prioritized VAT refund payments to agricultural holding companies, ignoring amounts claimed as budget refunds by other eligible economic entities (including utility companies). This, in turn, led to lawsuits from these entities, and their collection from the state budget of at least UAH 2 million in penalties, in addition to the claimed budget refunds. NABU and SAPO have been investigating this case since at least 2017.
