Antonov: Ukrainian aircraft manufacturer wins Russian court case against Russian oligarch

antonovA year ago, the Antonov State Aircraft Plant filed a lawsuit in the Samara Arbitration Court against the Aviakor concern (indirectly owned by Oleg Deripaska) seeking $5,35 million in patent royalties for the use of its trademark in the production and sale of An-140 aircraft. On July 4, it was reported that the Samara Regional Arbitration Court had ruled in favor of the Antonov State Aircraft Plant's claim on all counts.
The Ukrainian company's interests were represented by Ilyashev & Partners, whose representative (Roman Marchenko) reported that "By a court decision dated July 4th, the claims of Antonov State Enterprise in the amount of over $2,9 million were satisfied and are subject to recovery in favor of our client." Details of the case were not disclosed because, as Vladimir Zakharov, head of Ilyashev & Partners' Moscow office, noted, "...The court hearing was closed due to the fact that the subject of the proceedings is directly related to the commercial secrets of the parties involved in the case..."
The preconditions for the litigation were the cessation of exports of military and dual-use goods to the Russian Federation (in connection with the annexation of Crimea by the Russian Federation and the war in Donbass), the termination of intergovernmental agreements on cooperation in the field of military-technical cooperation (in force since 1993) and the suspension of production of AN series aircraft by Aviakor due to the lack of supplies of Ukrainian components and the impossibility of organizing import substitution.
