On March 24, 2021, the Northern Commercial Court of Appeal upheld the appeal of Philip Morris Ukraine CJSC and Philip Morris Sales and Distribution LLC, reports Finbalance.
Thus, the appeal court overturned the decision of the Kyiv Commercial Court of August 5, 2020, and issued a new decision, which satisfied the plaintiffs' claim and cancelled the fines imposed on them by the Antimonopoly Committee in 2019 in the total amount of UAH 1,200,000,000.
Previously, the Philip Morris Group intended to pay the fines to avoid the daily penalty, which, according to the law, amounts to 1,5% of the fine amount.
"As a reminder, in October 2019, the Antimonopoly Committee fined four of the largest tobacco manufacturers (Philip Morris, JT, Imperial Tobacco, and British American Tobacco) and the distributor Tedis Ukraine a combined UAH 6.5 billion. The AMCU then ruled that Tedis Ukraine's monopoly in the distribution market had been illegally established as a result of concerted actions by the company and tobacco manufacturers. The AMCU also recommended that the manufacturers take measures to limit their monopoly and promote competition in the cigarette distribution market," the publication writes.
