The Supreme Commercial Court upheld the ownership of Iv-Invest Ltd., LLC, over 1 square meters of non-residential premises in central Odessa. This was confirmed by a ruling dated May 11.
These premises ceased to be municipal property in 2010. At that time, the Odesa City Council effectively exchanged 23 non-residential premises in the city center for an administrative building on Stankobudilna Street, paying an additional 1,47 million hryvnias. The administrative building's value was significantly inflated. As a reminder, the state lost the presidential residence in Mezhyhirya under the "exchange for state property" scheme. At that time, the state received two dilapidated buildings on Parkova Road in Kyiv.
23 communal premises were acquired by Art LLC, which then resold them to other companies. For example, on November 12, 2010, Art transferred the premises to Elas-Kombi and Stanford-Invest, respectively, which resold the premises to Iv-Invest Ltd. in May 2011.
In 2014, the agreements between the city council and Art LLC and the city council's decision approving the list of properties subject to privatization were declared invalid.
In the spring of 2015, the Odessa Regional Prosecutor's Office filed a lawsuit seeking the return of illegally expropriated premises to the city, which ended up in the ownership of Iv-Invest Ltd. However, the courts at all three levels rejected the claim.
As the Supreme Commercial Court explained, the owner's right to transfer property to another person precludes the possibility of recovering it from a bona fide purchaser. The mere invalidation of the council's decisions and contracts does not in itself indicate the city council's lack of right to alienate the premises.
As a reminder, in April, the Supreme Commercial Court ruled that Avers Stroy LLC must return the premises at 8 Lanzheronovskaya Street to the Odessa City Council. This is one of the 23 premises that were alienated to the Art company in 2010.
The addresses of these 23 premises are: Torgovaya St., 29/31; Lanzheronovskaya St., 8 and 21; Leo Tolstoy St., 6; Grecheskaya St., 40; Richelievskaya St., 4 and 12; Ekaterininskaya St., 22 and 25; Bolshaya Arnautskaya St., 55; Nechipurenko Lane, 15; Fontanskaya Doroha, 16/6; Zatonskogo St., 1.
The founder of Iv-Invest Ltd. is the London-based company Green Planet Ltd., whose beneficial owner is listed as Alexander Shevlyakov. From 2010 to 2014, Iv-Invest Ltd. was founded by the London-based company Intera Trading Limited (liquidated in 2015), whose owner was Ivanna Shevlyakova.
From 2010 to 2014, Sergey Mashyanov served as the director of Iv-Invest Ltd. Since 2014, he has headed the Department of Consumer Market Development and Consumer Rights Protection of the Odessa City Council. Mashyanov is a co-founder of the Russian Club NGO, which also includes prominent pro-Russian politician Igor Markov (read more: Igor Markov: Criminal and Separatist ), former Odessa Regional Council deputy Konstantin Rozov (who served as an aide to MP Markov during the Yanukovych era), former regional council deputy Vadym Savenko, who is fighting on the side of pro-Russian terrorists in Donbas, former member of the Odessa City Council executive committee Sergey Prodayevich, brother of former judge of the Odessa Regional Commercial Court Valentyn Prodayevich, and others.

Mashyanov is also a co-founder of the Ark service cooperative together with Yuriy Goncharenko, a former assistant to the People's Deputy (2012-2014) from the Party of Regions Gennady Trukhanov , who is now the mayor of Odessa, as well as Valentyna Zub, a former assistant to the Party of Regions member Oleksandr Presman.
From 1999 to 2004, Mashyanov was a co-founder of Leta LLC together with former MP Oleh Radkovsky, who is now the first deputy chairman of the Odessa Regional Council, and Volodymyr Bodelan, the son of the former mayor of Odessa.
Since 2014, Sergey Sokolov has been the director of Iv-Invest Ltd. Interestingly, his namesake, Valentina Sokolova, who was Presman's assistant, is the director of GMG Content LLC, which became the owner of the premises at 1 Zatonskogo Street.
