The Dalnitsky village council declared the "necessary" enterprise, Fortuna LLC, the winner of the tender.

391202617Following a competitive bidding process, the Dalnitsky Village Council of the Ovidiopol District of the Odessa Region entered into a contract with Fortuna LLC on February 17, 2015, for the planning of a 500-meter-long slope on the coast of the village of Gribovka in the Ovidiopol District of the Odessa Region. The cost of the work was UAH 9,346,314.00.

A total of three companies participated in the bidding, namely Fortuna LLC, Dorbudinvest-Ost LLC and Garant-Budservis LLC, of ​​which, according to the protocol for disclosing bids for the competitive bidding, Garant-Budservis LLC offered the lowest price – UAH 9,859,910.00, which was UAH 761,212.00 less than the bid offered by the winning bidder.

During an analysis of the tender, the NGO "Rule of Law" discovered a distortion of the competitive bidding results. According to the bid disclosure protocol, the initial price offered by Fortuna LLC was UAH 10,621,122.00, while the procurement results report indicated a different price—UAH 9,346,314.00—which was lower than that offered by Garant-Budservis.

Based on this, one can conclude that Fortuna LLC's price proposal was deliberately reduced in order to secure the victory for a "desirable" company. However, no documents explaining this strange action by the tender committee were published on the public procurement website.

To prevent violations of legislation in the area of ​​public procurement, the public organization "Rule of Law" appealed to the competent authorities of the Odessa region, as well as to the tender customer, demanding an investigation into illegal actions by officials and the prosecution of those responsible.
