"Global Sale" is welded on "Kievpastrans"

Kyivpastrans, a municipal enterprise, purchased 3 million liters of diesel fuel for its bus fleet, spending 146 million hryvnias. Rivne-based KM Energy LLC will supply half of the diesel fuel. This company also won the auction for the other half of the fuel based on the "best price" criterion, but Kyivpastrans, on dubious grounds, decided to give preference to one of its "favorite contractors," Global Sale LLC. This company is part of the KLO Group and has received the largest amount from Kyivpastrans for diesel fuel supplies over the past seven years—500 million hryvnias (a quarter of all such contracts). Interestingly, the Kyiv City Council previously asked the Kyiv City State Administration's anti-corruption department to investigate the involvement of Kyivpastrans officials in the creation of a corruption scheme and the embezzlement of budget funds for the purchase of diesel fuel, including from Global Sale LLC, writes HF.

As reported by KV from an announcement in the ProZorro electronic public procurement system, on October 27 and November 9, 2022, Kyivpastrans* entered into two contracts for the purchase of Euro-5 diesel fuel. The total value of the two contracts was UAH 145,91 million.

The first contract (priced at UAH 73,06 million) was signed with KM Energy LLC**, which is to supply diesel fuel produced in the Republic of Lithuania at UAH 48,7 per liter. The second contract (priced at UAH 72,85 million) was signed with Global Sale LLC***, which is to supply Romanian-produced fuel at UAH 48,56 per liter.

Both contracts provide for the delivery of 1,5 million liters of fuel by the end of this year to the addresses of the Kyivpastrans Route Service and four bus depots - No. 2, 5, 6 and 8.

In the first tender, KM Energy LLC offered the best price among other bidders—Tradelim LLC, Global Sale LLC, and Stylish LLC. Only Global Sale LLC and KM Energy LLC competed for the second consecutive bid. KM Energy's bid was the more favorable, but despite this, the company was not awarded the second contract.

Kyivpasstrans explained that KM Energy LLC's proposal was rejected by its representatives, who failed to provide copies of the signed agreement within the specified deadline. KM Energy LLC disagreed with this explanation and even provided a scanned copy of the accompanying letter with a Kyivpasstrans representative's signature. However, Kyivpasstrans responded that they had no employee with the last name provided by the company, had not received any documents, and therefore, any claims by KM Energy were unfounded.

Global Sale profits from Kyivpastrans: diesel purchases

Since the ProZorro system was established in 2015, Kyivpastrans, including current contracts, has purchased 87 batches of diesel fuel worth UAH 1,95 billion. Twenty-three companies have supplied diesel fuel to the enterprise over these years. However, one of these companies has a significant advantage: a quarter of the funds for diesel fuel purchases—UAH 499,44 million—went to Global Sale LLC.

According to the Youcontrol analytics system, Global Sale LLC was registered in 2018 in the city of Vyshneve, Kyiv Oblast. Its authorized capital is 400 hryvnias. The founder, ultimate beneficiary, and director is Aurelia Malikova.

The Youcontrol system classifies Global Sale LLC as part of the KLO group, owned by businessmen Alexander Katz, Igor Chernyavsky, and Vyacheslav Steshenko. This group's main asset is the KLO gas station chain, which comprises 62 gas stations with on-site restaurants, shops, cafes, and car washes in Kyiv and the Kyiv, Zhytomyr, and Chernihiv regions. As a reminder, Vyacheslav Steshenko even ran for the position of Minister of Energy and Coal Industry in 2019.

According to Clarity Project, Global Sale LLC has signed 3285 contracts worth UAH 1,7 billion through public procurement. Its largest customer is Kyivpastrans, a Kyiv-based utility company, with which it signed 34 contracts worth almost UAH 528,81 million.

Global Sale LLC is mentioned in criminal case No. 32020110000000114, dated September 9, 2020, investigated by the Investigative Department of the State Fiscal Service in Kyiv Oblast on suspicion of illegal manufacture and storage of excisable goods. According to a ruling by the Kyiv Court of Appeal dated February 4, 2021, investigators found that illegally manufactured fuel was stored at gas stations and fuel and lubricant warehouses in the Belotserkovsky district of Kyiv Oblast, which was subsequently sold to individuals and businesses, including Global Sale LLC.

Glusko Ukraine LLC**** ranks second among the "favorite contractors" in the Kyivpastrans municipal enterprise. Over the past seven years, this company has received nearly 161 million hryvnias in diesel fuel bills.

LTD "Glusko-Ukraine" was registered in 2016 in Kyiv. The authorized capital is 100 hryvnias. The founder is Greenenergo Trading SA (Switzerland, Geneva). The ultimate beneficiary is Greek citizen Anifantakis Dimitrios Antonios, and the director is Marina Miroshnichenko.

Glusko-Ukraine LLC is part of the Proton Energy Group of Nisan Moiseyev (third from the left in the collage), who was the ultimate beneficiary of Glusko-Ukraine LLC until February 22, 2022.

KV previously reported that in 2016, the Russian state-owned company Rosneft, operating under the TNK brand, sold all of its Ukrainian assets to a then-little-known Swiss company, Glusco Energy, which is also part of Proton Energy Group. Moiseyev himself is linked to Viktor Medvedchuk (fourth from the left in the collage), a godfather of Russian President Vladimir Putin. Nisan Moiseyev stated that their relationship was friendly, not businesslike.

Glusko Ukraine LLC won 85 contracts worth UAH 1,58 billion in public procurement. One of its largest customers is Kyivpastrans, a public utility company, which awarded the company 16 contracts worth UAH 174,8 million.

Glusko-Ukraine LLC has several criminal cases under its belt. Specifically, officials of this company are suspected of organizing a scheme to illegally transport petroleum products from Russia to Ukraine in 2019-2020, evading customs control and tax evasion, resulting in significant losses to the state budget (case dated January 30, 2010, No. 020).

It should be noted that in July 2020, Oleksandr Pabat, a member of the 8th Kyiv City Council (then an independent member, previously a member of the Solidarity faction), asked the head of the Kyiv City State Administration's Department for Combating and Preventing Corruption to investigate Kyivpastrans's fuel supply tenders and the possible involvement of its officials in a corruption scheme and the embezzlement of budget funds. This included tenders that resulted in fuel supply contracts with Global Sale LLC and Glusko Ukraine LLC.

Third place in terms of the total value of contracts from Kyivpastrans KP went to Ventus Resource LLC*****, which received three contracts worth 155,57 million hryvnias.

Ventus Resource LLC was registered in 2013 in Bila Tserkva, Kyiv Oblast, and has since changed its address several times. It is currently registered in the village of Chabany, Bucha District, Kyiv Oblast. Its authorized capital is 300 hryvnias. The founder, ultimate beneficiary, and director is Oleksandr Zlenko.

Ventus Resource LLC's connections lead to the aforementioned KLO Group. Specifically, in a 2016 contract with Kyivpastrans for the supply of diesel fuel, this company listed the contact number (044) 494-31-11, which matches the number of KLO's head office. Furthermore, from 2016 to 2018, Ventus Resource LLC was registered at 2 Kyivska Street in the village of Sofiyivska Borshahivka in the Kyiv region, where a KLO gas station is located today.

In the entire history of Kyivpastrans' diesel operations, KM Energy LLC has only won the current contract, worth UAH 73,05 million. This company was registered in 2019 in Kostopil, Rivne Oblast. Its authorized capital is UAH 30 million. The founders and ultimate beneficiaries are Yulia Mazur and Iryna Panashchuk, both registered in Rivne. Its director is Andriy Kruchok.

Yulia Mazur is the ultimate beneficiary of four other companies, including SP Life LLC. It was founded by Roman Zinkov, who unsuccessfully ran for the Rivne City Council in 2020 as a candidate for the Rivne Together party (leader is current Rivne City Council Secretary Viktor Shakirzyan).

Following participation in public procurement, KM Energy LLC received 49 orders worth UAH 132,85 million. The current contract with Kyivpastrans is the most expensive contract the LLC has ever received. Previously, KM Energy LLC's largest client was the Rivne Municipal Transport Enterprise, from which it received 18 contracts worth over UAH 20 million.

In November 2021, residents of Sarny, Rivne Oblast, complained about a KM Energy gas station located there, claiming it was harmful to their health and lives and posed a threat to the environment. However, KM Energy refused to allow state environmental inspectors from the Poliesie District to inspect the gas station, and the inspectors forwarded the incident reports to law enforcement.

KM Energy LLC is involved in criminal proceedings (No. 62020240000000087). Investigators are reviewing the legality of issuing fuel retail and storage licenses to several companies, including KM Energy LLC, by officials of the State Fiscal Service in Rivne Oblast.

As KV has repeatedly reported, Kyivpastrans is regularly implicated in corruption scandals that become the subject of criminal investigations. Specifically, the Main Investigative Department of the National Police is seeking evidence that Kyivpastrans officials embezzled and misappropriated budget funds during the 2017 purchase of modern waiting pavilions with built-in trash bins, as well as capital repairs to buildings and structures.

Furthermore, the Security Service of Ukraine (SBU) has been investigating possible embezzlement by the management of Kyivpastrans since September 2020. Preliminary investigations are underway into the enterprise's collaboration with at least eight companies, to which municipal transport companies have transferred approximately 406 million hryvnias over the past three and a half years.

The Kyivpastrans municipal enterprise was founded in 2011 by the Kyiv City Council. Since August 30, 2016, it has been headed by Dmitry Levchenko (first on the left in the collage). The enterprise is subordinate to the Department of Transport Infrastructure of the Kyiv City State Administration (KCSA), which has been headed by Ruslan Kandybor (in the collage - second from the left).

From April 25, 2016 to April 25, 2017, he was in charge of this department.
