The Kharkiv Regional Court of Appeal overturned the decision of the Chervonozavodsky District Court of Kharkiv and upheld the appeal of Agroset LLC to seize the company's documentation.

According to Agroset LLC Director Alexander Bocharov, the Court of Appeal's decision was issued on November 11. According to the Court of Appeal, the Chervonozavodsk Court's decision was executed in violation of Ukrainian law, and the prosecutor's office's investigative actions exceeded its authority. As a reminder, in connection with fabricated criminal cases brought against his company, the Chervonozavodsk District Court authorized prosecutors to seize documentation, including lease agreements with shareholders. This resulted in the disruption of the farm's operations and violated the rights of the shareholders. Therefore, this decision was appealed.

Agroset LLC cultivates approximately 6 hectares of land in the Balakliya district of the Kharkiv region. The company's wheat yield was 6,8 tons per hectare, compared to the district average of 5,1 tons per hectare, according to 2014 data. This company also manages and develops dairy farming in the region. The company employs 140 people.

The Agrain agricultural holding, which includes Agroset LLC, is the largest in Ukraine. The holding employs over 4,500 people. It cultivates approximately 130,000 hectares of land in six regions. Rent for the land is regularly paid to 52,000 shareholders.

From November 3 to 11, the Kharkiv Regional Court of Appeal has already reviewed and upheld 26 complaints from the Agrain agricultural holding against the actions of the Kharkiv Regional Prosecutor's Office.

Agrain agroholding companies will challenge eight more decisions by the Chervonozavodsky District Court to seize 70,7 tons of corn stored in fields. They will also appeal 18 decisions by the Chervonozavodsky District Court of Kharkiv Oblast to re-seize 149,200 tons of wheat, corn, and sunflower seeds stored in elevators. These cases will be heard by the Kharkiv Oblast Court of Appeals on November 13-14.
