Asteris, a company owned by the Suprunenko brothers, has successfully overturned a court ruling that declared the lease of a plot of land at 46 Shchekavitskaya Street illegal. The case will be retried due to newly discovered circumstances. This is according to a ruling by the Kyiv Commercial Court. Our pennies.
It is known that in 2012, Asteris received a 25-year lease on 1,08 hectares of land in Podil. The land was transferred for the construction of an administrative, hotel, and residential complex, with the existing buildings to be demolished. The basis for the land transfer was that Asteris had purchased the premises located on the site in 2009.
In 2013, the prosecutor's office won a lawsuit challenging the Kyiv City Council's decision to lease the land. The court ruled that the site is part of the Ancient Kyiv State Historical and Architectural Preserve, and development on it required approval from the Podilsky District Administration of Kyiv, permission from the Main Department for the Protection of Cultural Heritage of Kyiv, and the holding of public hearings, which had not been done. Furthermore, since the site is designated as land of historical and cultural significance, the lease required approval from the Verkhovna Rada. Furthermore, the letters from the Main Department for the Protection of Cultural Heritage and the State Service for National Cultural Heritage did not mention the possibility of demolishing existing buildings and developing the site.
Asteris filed a petition for a review of the case based on newly discovered circumstances. The company stated that it had a development permit despite the protected status of the area. In support of this, Asteris presented a report on the disputed site issued by the Research Institute for the Protection of Monuments. The Institute's report stated that the existing buildings on the site are of no historical or cultural value and may be demolished. This document was prepared in May 2016.
Thus, citing these documents, the court overturned the 2013 trial court decision. A new hearing is scheduled for August 8. The case will be heard by the Kyiv Commercial Court.
Asteris is registered to Paladis LLC and Equitas Legal Center LLC. The owners of both companies are listed as Vyacheslav and Oleksandr Suprunenko. Vyacheslav Suprunenko is a former Kyiv City Council member and the son-in-law of former Kyiv Mayor Leonid Chernovetskyi. Oleksandr Suprunenko is an independent member of the Verkhovna Rada of Ukraine.
