The Prosecutor General's Office failed to return to the state the house expropriated by the company of Tabachnik's brother.

Shevchenko-27a-300x284The Prosecutor General's Office failed to return to the state the house that was expropriated in favor of the company of the brother of the former Minister of Education and Science, Dmitry Tabachnik (Read more about it in the article Dmitry and Mikhail Tabachnik. Brother for brother). This became known to the publication "Nashi Groshi", which cites the ruling of the Kyiv Commercial Court dated October 8, 2015.

This is a non-residential building located at 27A Tarasa Shevchenko Blvd., Kyiv. This building is owned by San 11 LLC.

Previously, the building was state-owned and operated by the Institute of Innovative Technologies and Educational Content. However, in August 2011, the State Property Fund leased the building to San 11 LLC. The company planned to house a publishing house for print media and other publishing products there.

In December 2012, the Ministry of Education transferred the building to the state-owned enterprise InfoResurs, and then, without a competitive bidding process, the 556-square-meter space was sold to the company San 11 for 6,58 million hryvnias. The company received the right to purchase the building because it had "made permanent improvements to the building amounting to more than 25% of its value."

The Prosecutor General's Office filed a lawsuit seeking the return of the building to the state, arguing that the privatization was in violation of current legislation. Furthermore, the company "San 11" was not listed in the state registry as an entity engaged in educational and scientific activities. A representative of the Prosecutor General's Office in court stated that the building in central Kyiv is designated a cultural heritage site and its lease must be approved by the authorized body, which had not been done. Furthermore, the monetary valuation of the building should have been conducted in accordance with the law on the protection of cultural heritage and calculated using a special methodology of the Cabinet of Ministers. However, the court dismissed the lawsuit and upheld the ownership of the building in central Kyiv as "San 11" LLC.

Media reports indicate that the actual address of the company "San 11" is the same as the address of the TIKO-Construction office center, which belongs to Mykhailo Tabachnyk, the brother of former Minister Dmytro Tabachnyk. The owner of "San 11" is the Belize offshore company "Sartoris Impex S.A." Until 2012, the company was registered to Maksym Glushchenko, a resident of the village of Poradovka in the Kyiv region. Prior to this, "San 11" was owned by Obukhiv City Council members Vitaliy Bondarenko and Yuriy Budyuk. The latter is known as an expert in the appraisal and sale of state property during privatization.
