SBU Head V. Hrytsak failed to file a declaration of assets authorized to perform state or local government functions for 2015. His declaration, like those of other SBU leaders, is missing from the unified state register of declarations posted on the website of the National Agency on Corruption Prevention. Journalist Volodymyr Boyko highlighted this fact today.
Thus, the SBU leadership ignored the requirement of Article 45 of the Law on the Prevention of Corruption, which obliges the head of the SBU, as well as officials and employees of this agency, to submit annually, by April 1, a corresponding declaration for the previous year by completing it on the official website of the National Agency, using a form determined by the National Agency.
As far as we know, the SBU leadership has come up with nothing better to avoid filing e-declarations than... classifying them. To "legitimize" this scheme for evading filing, a conclusion was prepared stating that the declarations of SBU employees are documents containing state secrets. From a legal perspective, this is complete insanity, which should be classified not only as evasion of filing declarations but also as an official crime—abuse (exceeding) of official authority. Moreover, the SBU leadership has previously encountered no problems with filing declarations (in the context of their containing state secrets). Photocopies of the declaration of SBU head V. Gritsak, as well as the declarations of his deputies (S. Bazuk, M. Glugovsky, V. Malikov, P. Demchina, V. Poyarkov, O. Frolov), all submitted in paper form, are still posted on the SBU website.
It should be noted that this form of "filing" declarations is not required by current legislation, and according to available information, it was approved at the level of the SBU and NACP leadership. Even with such approval, it equally fails to comply with the requirements of the aforementioned law, and is a banal "excuse" presented to citizens as a report on the alleged declaration of information about their own and their family members' property, income, expenses, and financial liabilities. At the same time, unfortunately, citizens will not be able to view the declarations submitted by the SBU leadership for 2015.
