On June 5, 2015, the Kyiv Municipal Association for Green Construction and Maintenance of City Green Spaces, "Kyivzelenbud," accepted the bid of KIKSHI UKRAINE LLC for the purchase of tree seedlings following a tender held on April 7, 2015. The price of the seedlings was UAH 4,819,700.00.
In total, six enterprises took part in the competitive bidding: LLC "TM Garden Center "Dalas", LLC "GRINSAD", LLC "Drept", LLC "FLOREKS UKRAINE", KSP "Zaporizhzelengosp" of the Zaporizhzhia Regional Council, LLC "KIKSHI UKRAINE".
The lowest price was offered by KSP "Zaporizhzelengosp" of the Zaporizhzhia Regional Council - UAH 2,278,800.00, which was UAH 2,540,900.00 less than the bid of the winning bidder, as well as LLC "TM Garden Center "Dalas" - UAH 2,643,910.00, which was UAH 2,175,790.00 less than the bid of the winning bidder.
The customer initially accepted the offer from the Zaporizhzhya Zelengosp Enterprise of the Zaporizhzhya Regional Council, but subsequently refused to sign the contract. The customer cited incorrectly formatted envelope cover, failure to provide proof of product delivery in 2013, the omission of the amount specified in the essential terms of the contract, and the omission of the company's full name in the offer as reasons for rejecting the second-best offer, from TM Garden Center Dalas LLC.
From the above, it follows that the customer rejected the most cost-effective proposal on formal grounds, neglecting the opportunity to save 2 million hryvnias from the budget.
To prevent the loss of public funds, the Rule of Law public organization appealed to the competent authorities of the city of Kyiv, as well as to the customer of the tender, demanding an investigation into the illegal actions of officials, holding those responsible accountable, and terminating the illegal contract.
