The court rejected the appeal of CNTI UNGA LLC, a subsidiary of Kirovogradteplo, according to Nashi Groshi.
The complaint concerns the lease of an integrated property complex belonging to the state-owned heating network enterprise Kirovogradteploenergo. The decision was made by the Dnipropetrovsk Commercial Court of Appeal. The lease agreement was concluded in 2004, and the complex was valued at 36,1 million hryvnias.
In early 2005, the company filed a lawsuit demanding that the agreement be recognized as valid, even though it had not been notarized. The court upheld the claim, and in 2006, CNTI UNGA and the Kirovohrad mayor's office signed an additional agreement. Under this agreement, the buildings at 11 Akademika Korolev Street, the boiler house at 190 Moskovskaya Street, and the unfinished construction of the southwest boiler house at 2 Promyshlennaya Street were removed from the list of leased properties. The value of the premises was almost 3 million hryvnias.
Last year, Kirovogradtep filed a lawsuit seeking to have the supplemental agreement validated, even though it, too, had not been notarized. However, the court ruled in favor of the state-owned enterprise.
It was also revealed that CNTI UNGA owes the Kirovohrad City Council enormous rental debts, amounting to over 10 million hryvnias. It's also worth noting that CNTI UNGA LLC is owned by Oleksandr Kovalko, who previously served as Deputy Chairman of the Board of Naftogaz Ukrainy. His wife, Natalia, is the adopted daughter of former Prime Minister Anatoliy Kinakh. In 2015, Kovalko attempted to secure a nearly $30 million loan from the EBRD for CNTI UNGA LLC, which was granted to the Kirovohradteplo State Enterprise, but was unsuccessful.
