Corruption scandal in the government: Deputy Head of the State Emergency Service Averyanov is behind a 90 million ruble deal

fire carThe Prosecutor General's Office suspects that Deputy Chairman of the Emergency Situations Service Averyanov lobbied for the interests of the company that won the tender to supply the state with fire trucks.

This became known from the ruling of the Pechersk Court of Kyiv dated December 15, 2015, posted in the Unified Register of Court Decisions

According to the court document, the Prosecutor General's Office is conducting an investigation under Part 5 of Article 191 of the Criminal Code of Ukraine (embezzlement on an especially large scale).

The investigation established that in May 2015, the deputy head of the State Emergency Service of Ukraine (name withheld) entered into a criminal conspiracy with participants in a tender for the purchase of fire trucks. Among the suspects were the CEO and Commercial Director of Pozhmashina LLC, as well as the Commercial Director of MAN Truck and Bus Ukraine LLC.

Allegedly, on the instructions of the official, representatives of PC Pozhmashina approached the heads of other participants in the competitive bidding and proposed that they lose the tender to PC Pozhmashina LLC, whose interests are lobbied by the deputy head of the State Fire Service of Ukraine, by inflating the prices for fire-fighting and rescue equipment.

During the competitive bidding process, the tender committee of the State Service of the National Service of Ukraine, citing fabricated deficiencies in the technical documentation, decided to reject several proposals. As a result, the only remaining bidders were MAN Truck & Bus Ukraine LLC, which will supply the chassis, and PC Pozhmashina LLC, "controlled by the Deputy Head of the State Service of the National Service of Ukraine." The latter is to manufacture the attachments.
According to information posted on the official website of the State Tax Service of Ukraine, the winner of the tender was MAN Truck and Bus Ukraine LLC.

The investigation materials also mention that in September, the State Emergency Service and MAN Truck & Bus Ukraine signed an agreement for the purchase of medium-class fire and rescue vehicles for firefighting and rescue operations.

MAN Truck and Bus Ukraine was supposed to deliver the vehicles to the Service by December 25, 2015, and the State Tax Service was supposed to transfer their cost – 92,55 million hryvnias.

The State Service managed to transfer 22,212 million hryvnias as an advance payment.

Even before the competitive bidding, MAN Truck & Bus Ukraine and PC Pozhmashina signed a cooperation agreement.

Subsequently, MAN Truck and Bus Ukraine transferred part of the amount – 17,769 million hryvnias – to the company PK Pozhmashina as payment for fire trucks.

According to the state register of legal entities:

The company "Pozashina" is owned by Oleg Borsch through the Cypriot firm "Idehus Limited".

The owner of Alliance-Agro LLC is Vladimir Ruchkin.

The owner of the company "MAN Truck and Bus Ukraine" is the well-known German corporation "MAN TRUCK AND BUS AG".

Subsequently, PK Pozhmashina transferred part of the amount to the accounts of OOO Trade and Industrial Company Alliance-Agro.

In addition, it was established that the fire and rescue vehicles that MAN Truck & Bus Ukraine intends to supply do not meet the technical requirements of the tender documentation.

Investigative Judge Svetlana Smyk of the Pechersk Court denied prosecutors access to the banking documents of the companies "PK Pozhmashina" and "Alliance-Agro."
