Kyiv's Higher Commercial Court has ordered Rinat Akhmetov's mobile operator Astelit (TM life:)) to pay 493,21 hryvnias to British musicians Lily Allen and Greg Kurstin. The ruling was issued because the operator's video ad illegally used the song "Fuck You," which is owned by the British musicians, according to AIN.UA.
The lawsuit against Astelit was filed by Comp Music Publishing LLC, which protects the English-language singer's copyright in Ukraine. Astelit filed an appeal, but the court dismissed it.
For their part, Comp Music Publishing noted that, upon noticing the copyright infringement, they contacted Astelit, the operator, for clarification. Akhmetov's company responded that the rights to the composition were granted by Shutgroup, and that the music was composed by Vitaly Rozinko. After several expert examinations, it was determined that the composition in the video indeed belonged to the British composers, and in March 2013, the copyright holder filed a lawsuit against Astelit.
The Kyiv Commercial Court ruled that a commercial for the mobile operator life:) aired in 2010 did indeed feature a variation of a musical composition by Lily Allen and Greg Kurstin. As the court noted, the 15-second commercial was aired 4369 times on 20 national channels.
