The capital's District Administrative Court has reinstated Anatoly Sirenko, the head of the State Traffic Inspectorate (GTI), who was subject to lustration and dismissed from his position in April 2015. This information was reported to journalists by Tatyana Kozachenko, head of the Ministry of Justice's Department for Lustration Issues.
Kozachenko noted that in December 2015, the court upheld Sirenko's claim and reinstated him in his position.
It is known that the former head of the State Traffic Inspectorate, citing a previous court ruling, reduced his tenure as deputy head of the Kyiv Oblast Ministry of Internal Affairs to less than one year. Therefore, Mr. Sirenko is not subject to the "Law on the Purification of Power," as lustration applies to individuals who held senior government positions for more than one year during Yanukovych's presidency.
The Kyiv Administrative Court took these arguments into account and overturned the Ministry of Internal Affairs' order dismissing Anatoliy Sirenko. The court of first instance also reinstated Sirenko as head of the Kyiv Ministry of Internal Affairs' State Traffic Inspectorate Department, effective April 22, 2015.
Ms. Kozachenko stated that the Ministry of Justice will appeal the decision of the first instance court.
