Alexey Lyubchenko
Former Deputy Chairman of the State Tax Administration Alexey Lyubchenko is not allowed to hold public office because he is subject to lustration. сообщает OUR.
However, the former official is trying to obtain the position of deputy head of the State Tax Service.
Journalists explained the reasons why Lyubchenko cannot count on this position:
“Lustration is a prohibition established by law or a court decision on certain individuals to occupy certain positions (be in service) (hereinafter referred to as positions) (except for elected positions) in state authorities and local government bodies.
For ten years from the date of entry into force of this Law, positions in respect of which a cleansing of power (lustration) is carried out may not be occupied by persons specified in parts one, two, four and eight of Article 3 of this Law, as well as persons who have not submitted, within the time period specified by this Law, the applications provided for in part one of Article 4 of this Law (Part 3 of Article 1 of the Law of Ukraine "On the Cleansing of Power").
The ban applies to individuals who held the following positions for a total of at least one year between February 25, 2010 and February 22, 2014:
- The Prosecutor General of Ukraine, the Chairman of the Security Service of Ukraine, the Chairman of the Foreign Intelligence Service of Ukraine, the Head of the State Security Service of Ukraine, the head of the central executive body that ensures the formation and implementation of state tax and/or customs policy, the tax police, their first deputy or deputy, the Deputy Minister of Internal Affairs of Ukraine;
- the head, deputy head of an independent structural unit of the central body (apparatus) of the Prosecutor General's Office of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, the Ministry of Internal Affairs of Ukraine, the central executive body that ensures the formation and implements state tax and/or customs policy, the tax police.
It is worth noting that in the period from February 25, 2010 to February 22, 2014, Lyubchenko held the following positions:
- Deputy Chairman of the State Tax Service (deputy head of the central executive body that ensures the formation and implementation of state tax and/or customs policy) (1 year 3 months);
- Director of the State Tax Service Department (head of an independent structural unit of the central executive body that ensures the formation and implementation of state tax and/or customs policy) (9 months).
- Regarding the position of the Chairman of the State Tax Service (the head of the central executive body that ensures the formation and implementation of state tax policy), measures are being taken to cleanse the government (lustration) (clause 2, part 1, article 2 of the Law of Ukraine "On the Cleansing of Government")," writes NASH.
Thus, Lyubchenko cannot hold this type of position for ten years (from 16.10.2014 to 16.10.2024).
