
NABU has completed its investigation into the Rotterdam+ case.
The updated composition of the SAP prosecutors' team, after reviewing the materials of the so-called "Rotterdam+" case, made a number of procedural decisions in the proceedings, writes Word and Deed.
The department's press service reported this.
Following the joint work of a renewed team of prosecutors and NABU detectives, as well as a detailed analysis of the evidence collected in the case, a decision was made to notify six individuals involved in the introduction of the so-called "Rotterdam+" formula about an amendment to the previously notified suspicion of the assignment of 18,87 billion hryvnia in damages to electricity consumers during 2016-2017.
The following persons were informed of the change of suspicion:
- former Chairman of the National Commission for Regulation of Energy and Public Utilities (hereinafter referred to as NKREKU);
- Director of the State Enterprise “Market Operator” (at the time of the introduction of “Rotterdam+” - a member of the National Commission for State Regulation of Energy and Public Utilities);
- to the head of the department of the National Commission for State Regulation of Energy and Public Utilities;
- to the head of the NKREKP department;
- to the deputy commercial director of one of the private companies of the group - a key operator in the Ukrainian heat generation market; - to the director of the department of one of the companies of the said group.
The actions of all individuals are classified as crimes under Part 2 of Article 364 of the Criminal Code of Ukraine. Representatives of private companies are charged with complicity.
Given the limited timeframe for the pre-trial investigation, on September 22, 2022, the SAP and NABU, having deemed the evidence collected during the pre-trial investigation sufficient to file an indictment, informed the defense of the completion of the pre-trial investigation and granted access to the criminal proceedings.
At the same time, SAP prosecutors, together with NABU detectives, continue their investigation into possible damages caused under the so-called Rotterdam+ formula during 2017-2018.
As is known, SAP prosecutor Denis Demkiv for the fourth time closed the Rotterdam+ case.
NABU has completed its investigation into the Rotterdam+ case once again.
As a reminder, according to investigators, DTEK Grids CEO Ivan Gelyukh and another DTEK manager, Boris Lisovyi, discussed the possibility of implementing the "Rotterdam Plus" formula in advance of its adoption, in a preliminary agreement with former head of the National Commission for State Regulation of Energy and Public Utilities (NEURC), Dmytro Vovk; former member of the National Commission, Vladimir Yevdokimov; deputy head of the NEURC's energy market department, Taras Revenko; and head of the department within that department, Vladimir Butovsky. Initially, the formula was supposedly intended to apply only to coal delivered to Ukraine via ports. However, the amount of such coal amounted to approximately 130 tons per year, out of a total of 25,5 million tons of this grade of coal used at thermal power plants.
Therefore, all the aforementioned individuals later reached an agreement to apply this formula to the entire coal supply, as proposed by NEURC officials at a meeting on January 28, 2016. On March 3 of that year, after receiving permission from the Antimonopoly Committee of Ukraine, officials from the National Commission reviewed the agenda, which included the "Rotterdam Plus" formula, which was approved at that meeting. A preliminary assessment allegedly established UAH 18,87 billion in damages from NEURC's implementation of this formula, as it generated excess profits for the DTEK group of companies, which held a 70%-80% share of thermal generation.
