The NBU is unable to return the money paid to Imexbank.

nbuA case initiated by the NBU to recover funds from a stabilization loan (amounting to approximately 300 million hryvnias) from the owner of Imexbank (Leonid Klimov) was lost in court. According to primary sources, the funds were transferred on November 28, 2014, but the bank's license was revoked on May 27, 2015. It was considered that the NBU could pursue claims against Klimov, who had pledged all his assets as guarantor for this amount.

 

However, the Odesa Oblast Court of Appeal overturned the earlier decision to recover the funds issued by the Primorsky Court (Odesa), finding that the six-month period for filing claims had expired before the lawsuit was filed. Indeed, the lawsuit was filed on January 6, 2016, which was outside the legally prescribed timeframe.

 

The court explained: "...even if a claim was filed within the term of the surety and the surety failed to fulfill the requirements specified therein, the creditor has no right to satisfy a claim filed outside the specified period, since the substantive right ceased upon expiration of the term..." The court set November 27, 2015, as the last day of the surety's validity. However, the NBU stated that it had already appealed this decision and intends to seek a refund of the funds to the state treasury.
