On February 10, 2016, the Donetsk Regional Commercial Court initiated proceedings on the NBU's claim against PJSC Spetsavtomatika for the foreclosure of property totaling UAH 309,85 million. OJSC Imexbank is a third party in this case.
The court ordered the National Bank to provide evidence of the loan provided to Imexbank, as well as a bank statement for the overdue loan, overdue interest, penalties, and evidence of the collection of the debt of Imexbank OJSC at the expense of property guarantors.
In its lawsuit, the NBU alleges that in December 2014, it provided Imexbank with a UAH 300 million stabilization loan, secured by real estate, property assets, and a surety. Furthermore, in March 2014, Imexbank received UAH 495 million in stabilization loans from the National Bank.
In turn, Imexbank stated in court that its loss for 2015 amounted to UAH 9,77 billion. This was primarily due to deductions to the reserve for the impairment of loans and funds in other banks, which amounted to UAH 11,93 billion. This is despite the fact that as of January 1, 2015, the financial institution's assets stood at UAH 11,38 billion. The Deposit Guarantee Fund stated that as of January 1, 2016, UAH 4,1 billion, or 95,4% of the amount due for reimbursement, had been paid to Imexbank depositors.
As a reminder, on January 15, 2015, the NBU classified Imexbank as a problem bank, and on May 21, 2015, it ordered its liquidation. Imexbank was controlled by MP Leonid Klimov.
