The High Anti-Corruption Court overturned a NABU detective's decision to close a criminal case regarding the illegal withdrawal of funds from the accounts of Cypriot companies associated with former Ukrainian President Viktor Yanukovych, which was allegedly committed erroneously during the execution of a sentence issued by the Kramatorsk City Court. It was established that NABU detectives conducted a pre-trial investigation into criminal case No. 52017000000000494 dated July 17, 2017, regarding the write-off of cash and domestic government loan bonds of Wonderbliss ltd, Loricom Holding Group ltd, Foxtron Network, with the execution of the verdict of the Kramatorsk City Court of Donetsk Oblast dated March 28.

As a reminder, this concerns the special confiscation of domestic government loan bonds (DGLBs) and funds from the accounts of 10 offshore companies totaling approximately $1,5 billion, which the media has dubbed the so-called "common fund" of a criminal group led by former Ukrainian President Viktor Yanukovych.

Based on the investigation's findings, by a NABU detective's order dated May 13, 2022, the criminal proceedings were closed due to the absence of criminal activity in the actions of officials of the State Savings Bank of Ukraine, the Prosecutor General's Office, the State Financial Monitoring Service, and the Ministry of Finance.

However, disagreeing with the investigators' position, the lawyer for the aforementioned Cypriot companies filed a motion with the High Anti-Corruption Court (HACC) to reopen the investigation. In his complaint, he noted that NABU detectives, in particular, failed to establish the reasons for the discrepancies between the names of the legal entities in the operative part of the verdict of the Kramatorsk City Court of Donetsk Oblast dated March 28, 2017, in connection with the execution of which the funds of the injured companies were transferred, and the names of the companies whose funds were written off in the criminal proceedings. Furthermore, according to the lawyer's complaint, the petitions of the injured companies' representatives were not properly considered.

On September 29, 2022, the High Anti-Corruption Court overturned the NABU's decision to close the criminal proceedings.

As a reminder, we are talking about 13 billion hryvnias of budget funds, which, through a series of criminal schemes, the Ukrainian president's inner circle allegedly seized during his reign and transferred abroad.
