The Odessa seaport failed to win UAH 8,52 million from Firtash's company.

courtThe state-owned enterprise Odesa Seaport failed to recover UAH 8,52 million from Firtash's company, MSP Nika-Tera LLC (a specialized seaport). This was reported by the publication "Nashi Groshi," citing a ruling by the Mykolaiv Regional Commercial Court.

 

It is known that in 2007, the state-owned Odessa Seaport leased a mobile crane to Nika-Tera, a company that operated a mobile crane. On February 5, 2015, a fire broke out on the leased crane, damaging and destroying several engine room components. Citing expert assessments, the Odessa Seaport estimated the fire damage at UAH 8,52 million and filed a lawsuit against Firtash's company. In its lawsuit, the state-owned enterprise claimed that Nika-Tera, as stipulated in the contract, failed to implement sufficient fire safety measures.

 

However, the court dismissed the Odesa Seaport's claim. The Mykolaiv Commercial Court cited the plaintiff's failure to provide the court with the necessary evidence of breach of contract. Furthermore, the fire on the mobile crane, according to the court, does not constitute evidence of the lessee's failure to comply with the terms of its maintenance and operation. Nika-Tera, for its part, presented documentation of the inspection and maintenance of the leased property.

 

SME Nika-Tera is owned by companies associated with Ukrainian oligarch Dmitry Firtash.
