PrivatBank wins case over its head office building in Dnipro
The Supreme Court upheld the appellate court's decision to deny Okeanmash's attempt to overturn Privatbank's ownership of its head office building in Dnipro.
This was reported by the press service of PrivatBank.
The corresponding decision was made on Wednesday, September 28, by the Cassation Economic Court of the Supreme Court.
The building in question is currently used as the bank's headquarters in Dnipro, where over 4 employees work. It was transferred to the bank's ownership three months before its nationalization in 2016, as the subject of a mortgage foreclosed on to pay off a debt owed by a company affiliated with the bank's former owners.
How PrivatBank won the case
In 2016, Okeanmash, a company affiliated with the former owners and engaged in legal proceedings with Privatbank over the building since 2020, notified the bank in a letter of agreement to transfer the office building to it to prevent further debt buildup under the loan agreement.
Subsequently, in 2020, the company filed a lawsuit with the Dnipropetrovsk Regional Commercial Court demanding that PrivatBank be stripped of its ownership rights to the building in Dnipro. The court upheld the claim.
In two years, in April 2022, the court satisfied appeals from PrivatBank and the Dnipropetrovsk Regional Prosecutor's Office and dismissed Okeanmash's claim
