The state-owned Kazatsky Hotel suffered a financial blow, inflicted by violent raids on the property by privately owned commercial entities. The raider attack consisted of these entities entering into an illegal tripartite agreement on joint investment activities with the participation of a foreign investor without establishing a legal entity.
The extortionists' next step was to appeal to the Arbitration Institute of the Stockholm Chamber of Commerce and demand payment of over 13,5 million hryvnias, as well as the registration of joint shared ownership of the state-owned enterprise's real estate, valued at over 60 million hryvnias. Furthermore, officials of the private companies immediately appealed to the state enforcement authorities, demanding the enforcement of the foreign court's decision (and to date, 386,300 hryvnias have already been recovered).
But the military prosecutor's office of the Central Region of Ukraine stood in the way of the perpetrators: through the courts of three instances, a joint investment agreement involving a foreign investor was declared invalid: "The Military Prosecutor's Office of the Central Region of Ukraine has initiated criminal proceedings regarding the abuse of power by officials of the state-owned enterprise of the Ministry of Defense of Ukraine, the Kazatsky Hotel, in the interests of two private entities, as a result of which funds in the amount of UAH 386,3 were illegally collected from the state-owned enterprise (Part 2 of Article 364 of the Criminal Code of Ukraine – abuse of power or official position, resulting in grave consequences)."
Prosecutor's representatives are confident that they will be able to defend the interests of the state-owned enterprise and recover the illegally extorted funds. They also plan to continue their efforts and launch a criminal investigation into the perpetrators of the illegal actions and their potential accomplices.
