The Verkhovna Rada adopted the law “On the gas market.”
This idea was received with enthusiasm and strengthened the fight against the oligarchs.
However, the acceptance of the document does not mean the end of the market.
Ahead is the tedious process of preparing regulatory legal acts and their implementation.
The Secretariat of the European Energy Partnership was able to pass the law in a significant manner.
He has written a lot of speeches that have been declared at round tables and conferences on a lot of occasions.
This differentiates the functions of gas supply, transportation and gas distribution. The goal is to earn in such a way that the rulers of the regional gas companies, the largest of whom is Dmitro Firtash, pay for their corruption with the sovereign “pipe”. The value is significant to the status of operators of the GTS, PSG and regulator.
Utim, the law must be corrupt. For real changes to happen, the government needs to adopt a number of resolutions. “This is a basic law. It’s time to follow the review of by-laws,” said Mikhailo Gonchar, president of the Strategy XXI Center for Global Studies.
In his words, the previous law was also monstrous and similar to another energy package, but its implementation was not the best.
“The implementation of the document is stuck on the level of regulatory and legal acts. The stench was not widely accepted, but if accepted, there was little practical implementation. For example, the principle of free access to pipe work,” says Gonchar.
Experts are afraid that the regulations may save the privileged status of financial and industrial groups. A valuable negative aspect.
Then the gas market may be forced to reveal the final beneficiaries, tariffs will be formulated proactively and proactively, there will be a separation between the production, transportation and sale of gas.
There are also chances that tariffs for the transportation of fuel through the GTS and GDS will be transparent and formulated on a non-discriminatory basis. What is the result of all the “anti-crisis” resolutions with orders to buy gas from Naftogaz.
The new law applies a lot to irrelevant documents, for example, to the operator codes of the GTS, GDS, and PSG. What will be the status of the main regulatory act and the Memorandum of National Unity?
The role of the regulator and the AMCU will be important. Their responsibility will be unbiased and directly in line with the ideal market model prescribed by law.
If the AMCU will no longer have a monopoly, the concentration of significant parts of the market, the interconnection of legal entities and activities in a generally undesirable style, then laws and codes will be deprived of good declarative documents.
For those living in life, changes are possible, although not soon. For them, the choice of gas supplier is responsible for the intrigue with the choice of food. In this case, the postal owner is responsible for denying the opportunity to deliver the goods to the delivery person. There may be conflicts here.
Gas flows through the gas-dividing barriers that used to be used in the past. The adopted law prevents private companies from using them as government property, as was done under Yanukovych. It will soon begin to be a new struggle for control over these borders.
On the one hand, regional gas companies will be hesitant to buy leases and concessions and will be forced to increase gas tariffs through regulatory features.
Otherwise, there will be receptive people who, under the lights of European integration and the collapse of Europe, will try to “integrate” their interests into control over the timing. In power, it seems, we will become the first to test the path of implementing the law in life. It also addresses the problems of natural monopolies that the state supports.
“There is no particular optimism among market participants yet. Naftogaz is a single importer, saver and buyer of domestic gas. The monopolist is firing at all stages of the revolution. The real market is still far away,” says Gennady Kobal, an analyst at the consulting company Newfolk.
In European countries, everything worked out the same way: a basic directive was initially adopted, and behind it, regulatory documents were “followed” at the sovereign and corporate levels. True, the Europeans spent six rocks on it. In Ukraine, the law “On the Gas Market” is already gaining momentum.
This will have its own specific implementation of energy packages. According to experts, other energy packages, for example, free access to pipelines, have not yet been implemented in Ukraine. Then, at the same time, the standards of other and third energy packages will be implemented.
Experts respect that, regardless of the adoption of a completely clear law, at the stage of development and adoption of by-laws for the sector, there is a lot of trouble.
Analysts emphasize that in addition to the legislative framework and infrastructure, the market needs the mother resource itself to develop.
“The implementation of the adopted document will be discussed after the arrival of the market for companies that will extract resources and be able to compete with Naftogaz.” Everyone likes to repeat that it is the culprit of robbing the postal owner. The prote postalnik is to blame for mother’s gas,” Kobal guesses.
In my opinion, this resource may not be imported, but Ukrainian gas. “If the tariff policy has an effect, then the population’s life will be shortened. “Ukrgazvidobuvannya” therefore rejects excessive obligations that can be realized through a trader who operates this resource,” says Gonchar.
In addition, the remaining order will continue to separate importers and enterprises, forcing them to buy gas from Naftogaz. Private companies could not sell paliva. They scouted buyers and sold them at a discount of up to 1 thousand UAH, and paid taxes without clearing the discount, says the expert.
According to Gonchar, the monopoly of Naftogaz is planning to enter into this situation. In the world, as your financial situation improves, these preferences will be reduced, and other countries will deny the same opportunities.
The possibility of choosing a gas supplier after the implementation of the new law will be limited to only industrial workers and primary residents. Ideally, this choice is based on the customer's Internet service provider.
Relying on changes on the side of private companies will be most reassuring, but implementing the law in life will be unforgivable. There will be a complete package: the gas and electricity market, the national regulator, antimonopoly regulation, reconstitution Gonchar.
“Firtash and Akhmetov will react to the establishment of power monopolies. There will be a lot of work from the legal framework and the elimination of the monopoly of private companies,” the expert predicts.
Everything is not easy anymore. Zokrema, in part of reducing the possibility of private companies purchasing gas distribution systems on the rights of a sovereign license. It looks like there is every chance of opening another front with Firtash.
It is not excluded that these hundreds of hundreds will be raised to the banners of the fight against the oligarchs ahead of the local elections.
