The co-owner of the Borivazh grain terminal is attempting to appeal in court the decision to collect UAH 1 billion in debt from the company to PrivatBank.

The South-West Commercial Court of Appeal postponed the consideration of Agroterminal LLC's appeal for UAH 1 billion until October 11.

This was stated in a statement by the PrivatBank press service.

The plaintiff is trying to appeal the decision to collect UAH 1 billion in debt in favor of PrivatBank.

It is noted that despite the bank's objection, the court granted the defendant's new representative's motion to be allowed to review the case materials.

In October 2020, the Odesa Regional Commercial Court upheld PrivatBank's claims and ordered the early recovery of UAH 1 billion in debt owed by Agroterminal LLC under a loan agreement with a legal entity affiliated with the bank's former owners. The loan agreement was concluded in November 2016, just before the bank's nationalization.

The founder of Agroterminal LLC is Borivazh LLC. At the time of the bank's nationalization, the company was recognized as a related party. The company's debt to the bank is UAH 3,5 billion.

The ultimate beneficiaries of the company are Alexander Skotnik and Narek Budagyan (indirectly through Terminal-Yuzhny LLC), as well as Aresti Seodoro (through Octalensa Holdings LTD), Angonas Garofita Nicoleta (through Amertana Holdings LTD) and Emmanuel.

Let us recall that in November 2016 the court satisfied PrivatBank's claim for the recovery of UAH 1 billion from the co-owner of the Borivazh grain terminal, the Agroterminal company.

In September 2017, the Pechersky District Court of Kyiv seized the Borivazh grain terminal in the Odessa region, which belonged to Agroterminal Logistics.

In April 2018, PrivatBank sued the co-owner of the Borivazh grain terminal for one billion hryvnias for the defendant's failure to comply with the terms of the agreement dated November 4, 2016.
