land divisionThe court refused to return 6,99 hectares of forest land, which Vera Ulyanchenko had transferred to seven individuals, to state ownership. This was reported by Nashi Groshi, citing a ruling by the Vasylkiv Interdistrict Court dated December 9, 2015.

We are talking about lands located within the Ivankovichi village council of the Vasylkiv district of the Kyiv region.

It is known that in 2008, based on orders from Kyiv Regional State Administration Chairperson Vira Ulyanchenko, 6,99 hectares of forest were withdrawn from the permanent use of the Kyiv Forestry State Enterprise. Their designated use was changed to agricultural land and the land was transferred free of charge to seven individuals.

The regional prosecutor's office points out that the law was violated, as only the Cabinet of Ministers has the right to seize forests larger than 1 hectare. Furthermore, the procedure for changing the designated use of land plots was violated. The prosecutor's office also notes that the citizens failed to pay the state for losses incurred during forestry operations.

But the court reached the opposite conclusion. It relied on the fact that the land management plans had been approved by all the necessary authorities, and their compliance was confirmed by the findings of the state land management documentation review. Furthermore, the Kyiv Forestry Enterprise had approved the seizure of the plots. However, as the court pointed out, the Regional State Administration allocated seven separate plots to seven different individuals, so it cannot be said that a single forest tract exceeding one hectare was alienated.

The court also added that failure to pay for forestry losses is not grounds for recognizing the orders of the Regional State Administration as illegal, but can only be grounds for recovering these losses through the courts.

The prosecutor's office had 10 days to file an appeal, but there is no information in the State Register on whether this was done or not.

In 2008, plots of 0,99 hectares each were received by Alexander Anatolyevich Omelchuk, Igor Vasilyevich Mudretsky, Elena Viktorovna Pasenyuk, Maria Petrovna Sergiychuk, Olga Evgenyevna Chukhmanenko, Alina Vasilyevna Kondoruk, and Sergey Nikolayevich Tsyba. A few months after receiving the plots, the last three sold their plots to Listreid LLC. The latter was founded by Marina Zhuravleva, wife of former head of the State Forestry Agency Viktor Sivets, and Olga Ukhova, wife of the former head of the State Forestry Agency's Human Resources and Control Department.
