The Lviv Commercial Court of Appeal awarded 1,3 hectares of land to a company that built a hypermarket instead of a residential building.

courtOn February 18, 2016, the Lviv Commercial Court of Appeal overturned the Chernivtsi City Council's decision to invalidate the lease agreement under which 1,3 hectares of land had been transferred to Hyperbud LLC, according to Nashi Groshi.

In 2012, the Chernivtsi City Council leased a 1,3-hectare plot of land to the company "Giperbud" for 10 years for the construction of a multi-apartment residential building with integrated and attached retail and office space. According to the agreement, the City Council has the right to require the lessee to use the plot for its intended purpose.

However, in 2014, it was discovered that construction had begun on the site to build a hypermarket. There was simply not enough space for a residential building. Furthermore, experts determined that the hypermarket's construction violated building codes and could have negative consequences for the city's infrastructure.

The agreement stipulates that the land lease agreement may be terminated unilaterally by the city council. The Chernivtsi City Council did not consent to the hypermarket's construction and unilaterally terminated the agreement with Hyperbud.

The developer appealed this decision in court. On November 18, 2015, the Chernivtsi Regional Commercial Court dismissed the company's claim. However, the appellate court upheld the claim, ruling that the city council could only terminate the contract by mutual agreement or a court decision.

The company "Giperbud" is registered in Khmelnytskyi in the name of the company LLC "Max Art" of Galina Bevza.

As Andriy Oleynik, a member of the Public Control movement, reported on Facebook, on February 25, the Chernivtsi City Council decided to terminate the lease agreement with the company "Giperbud" and transferred the land to the Prospect Housing Cooperative. Prospect Housing Cooperative members include Nadiya Kotsur, Oksana Misiura, Iryna Pasir, Oleksandr Stepanov, Vasilisa Fedoryak, and Volodymyr Kharitesku.
