Mikhail Voevodin vs. Misha Luzhnetsky. A Kyiv court has accepted a lawsuit filed by a Russian "thief in law" to protect his business reputation.
The court was deeply affected by the insult to the Russian citizen using the phrase "representative of the Luzhniki group," even though this is mentioned in documents from the Security Service of Ukraine and Interpol.
On September 29, the Kyiv Court of Appeal will hear a lawsuit filed by a Russian "thief in law" against the RBC-Ukraine news agency, Public Television, and journalist Yuri Nikolov for the protection of his honor, dignity, and business reputation. сообщает media lawyer Klim Bratkovsky on the website ZN.UA.
We are talking about Mikhail Voevodin, who in official documents is described as a citizen of the Slovak Republic, Israel, and Russia, and, according to the Interpol National Central Bureau database, is one of the leaders of Russian organized crime groups.
The subject of the dispute is the phrase: “….representative of the Luzhnikovskaya group”….”The Luzhnikovskaya group is, first of all, businessman Mikhail Voevodin…”.
“This is despite the fact that the case materials contained official information about Vojvodina,” the lawyer writes:
Well from exile The court closed access to the case materials on the Unified Register of Court Decisions.
At the same time, according to Bratkovsky, the case contains citations of documents from the Security Service of Ukraine and decisions of the State Customs Service of Ukraine.
Thus, "... in January 2018, the Security Service of Ukraine received a notice from the National Police of Ukraine dated 22.01.2018 under No. 14/01/16-541 regarding the Israeli citizen Voevodin M.V..., who, according to the NCB Interpol database, is one of the leaders of Russian organized crime groups (the so-called "Luzhnikovskaya" organized crime group), known in the criminal world under the nickname "Misha Luzhnetsky", involved in extortion and legalization (laundering) of proceeds from crime, both in the territory of the Russian Federation and in EU countries."
Also, "...by the decisions of the State Customs Service of Ukraine dated August 16, 2019, No. 8-6455/1-19, dated August 23, 2019, No. 8-6451/2, No. 8-6453/2, Voevodin M.V., who is a citizen of the Russian Federation, Israel and the Republic of Slovenia, is banned from entering Ukraine for a period of 3 years. The reason for the ban on entry to Ukraine was the information received from the General Secretariat of Interpol about the "green" notice of the National Central Bureau of Interpol of the Russian Federation dated May 31, 2019, No. C355/62019, which states that Voevodin M.V. is a "thief in law", a member of an organized criminal group specializing in extortion and money laundering."
Moreover, according to the lawyer, Judge Tatyana Ilyeva of the Pechersk District Court of Kyiv, despite numerous violations of civil procedure, granted Voevodin's claim without any legal basis.
At the same time, the Kyiv Court of Appeal, represented by a panel of judges: Elena Ivanovna Shkorina (rapporteur), Lyubov Dmitrievna Polivach, Anatoly Nikolaevich Strizheus upheld the decision of Judge Ilyeva, reducing the defendant’s legal costs by 20 kopecks.
On August 25, 2022, Judge Natalia Valerievna Polischuk of the Kyiv Court of Appeal recused herself from the case, since her close relative, Dmitry Aleksandrovich Polischuk, was an assistant to the lawyer representing the interests of the party in the case.
Klim Bratkovsky also expresses bewilderment at how the cases of odious individuals end up before the same judges.
The lawyer recalled that the lawsuit Andrey Portnov The case against anti-corruption activist Vitaly Shabunin (case no. 757/35116/19-Ts) for the protection of honor, dignity, and business reputation was also heard by Judge Tatyana Ilyeva and a panel of appellate court judges consisting of Lyubov Dmitrievna Polivach and Anatoly Nikolaevich Strizheus. Shabunin lost the case at the time, but won it in the Supreme Court.
