In an investigation conducted by Oleksandr Chornovalov for the program "Schemes," he reports that the Kyiv Commercial Court of Appeal of Ukraine has lifted the seizure of the assets of Golden Derrick. The company owes a substantial sum to the state-owned NAK Nadra Ukrainy.
As a reminder, in 2012-2013, Golden Derrick was sold stakes in three gas production companies at the largest Sakhalin gas field by the former management of Nadra Ukrainy for just over 20 million hryvnias. This quickly enriched the company by 120 million hryvnias. However, Golden Derrick never paid Nadra Ukrainy for the state-owned stakes it had acquired. Therefore, the new management of the state-owned company filed a lawsuit against Golden Derrick seeking to terminate the contracts and return assets that generate millions of hryvnias monthly to Nadra Ukrainy.
Subsequently, by decision of the Kyiv Commercial Court, these agreements were terminated, and Golden Derrick was prohibited from any asset disposal. However, the Kyiv Commercial Court of Appeal overturned this prohibition. Therefore, the owner company can sell the stake for which it has not paid the state at any time.
Golden Derrick declined to comment on the court's ruling, or on the reasons for the company's rapid growth during Yanukovych's presidency.
According to the Unified State Court Register, three judges of the Kyiv Commercial Court of Appeal ruled in favor of Golden Derrick. Interestingly, Larisa Smirnova presided over the case. She was the one involved in the scandal surrounding Svoboda MP Oleh Osukhovskyi, who accused her of facilitating corporate raids.
As is well known, Golden Derrick is controlled by former ministers Eduard Stavytsky and Mykola Prysyazhnyuk through the Cypriot company Hartlog Limited. Yuriy Ivanyushchenko, popularly known as Yura Yenakievsky, is also a partner in the company.
