The Kyiv Commercial Court upheld some of the claims filed by S.Group, a leading snack food producer (brands include Semki, Kozatska Rozvaga, and Macho), against ATB, one of Ukraine's largest supermarket chains, for a total of UAH 2,4 million. This was announced by S.Group representative and Deputy General Director of Snack-Export LLC, Serhiy Bilyi, according to the S.Group press service.
According to him, on November 5, the court issued positive decisions on debt collection from ATB-Market LLC in favor of Chistaya Planeta LLC and DP YUMAK.
"These court decisions are just the beginning. Our group of companies is awaiting verdicts on the remaining claims. We have all the supporting documents proving that we fulfilled our contractual obligations to ATB, i.e., delivered the goods, but we still haven't received a refund. Therefore, ATB owes us a total of 42 million hryvnias," Belyi stated.
According to him, ATB's debt to Snack Export is the most significant.
Bely called on ATB-Market shareholders to end the conflict with dignity and pay off their debts as quickly as possible to reduce costs for both parties.
"Any conflict is a waste of time and other resources. Among other things, it's a question of the image of the ATB chain, which is increasingly becoming known as an unreliable organization. Workers at both ATB and S.Group companies cannot be held hostage to the personal relationships of shareholders," Bely stated.
A representative of S.Group called on the shareholder of ATB to stop pressuring his corporation with the help of corrupt security officials.
"If such attempts continue, we will report every such incident to the public. We are committed to the truth and the law," Bely said.
In October 2014, a group of companies within S.Group filed lawsuits in the Kyiv Commercial Court against ATB-Market seeking to recover outstanding debt for goods delivered, as well as impose penalties for late payment of UAH 42 million. On October 20, the court ordered the seizure of ATB-Market's funds in this amount.
All of the companies listed above, which are demanding debts from ATB, are part of the S.Group conglomerate, which is controlled by Sergei Rybalka after his exit from the S.I. Group corporation in August.
