Tatyana Kozachenko, head of the Ministry of Justice's lustration department, stated that five judges who made the decision to reinstate the 1996 Constitution have not yet been lustrated and are still serving in their posts.
According to Kozachenko, back in 2014, parliament recommended dismissing judges who violated their oaths and effectively attempted to amend the Constitution without authorization. Five other judges were dismissed under the Verkhovna Rada's quota, but those appointed by the president and the Council of Judges remained in their positions. These judges are being considered as witnesses in the Prosecutor General's Office's investigation into the usurpation of power.
The head of the department noted that the Constitutional Court of Ukraine, by law, has the right to review the constitutionality of the lustration law itself, but only in the absence of judges with a conflict of interest. The five aforementioned judges are: Constitutional Court Chairman Yuriy Baulin, Judges Serhiy Vdovychenko, Mykhailo Hultai, Mykhailo Zaporozhets, Oleh Serhiychuk, and Natalia Shaptalo. Interestingly, Shaptalo is also the rapporteur on this law.
According to Kozachenko, these judges should recuse themselves and notify the Council of Judges, but this was not done. Finally, a letter appeared on the Constitutional Court's website alleging that the judges were being pressured by the Minister of Justice and members of parliament, while some Constitutional Court judges stated that they were not under pressure.
