Judge Vadym Ivanchuk of the Kyiv District Court of Odessa: an example of judicial disgrace

Vadim Nikolaevich Ivanchuk has been a judge since 2003. Previously, he held the position of deputy chairman of the Kyiv District Court of Odessa.

 

 

 

Information from the declarations for 2011-2013 of Judge V.N. Ivanchuk:

 

Thus, based on the declarations of Judge Ivanchuk V.N., he and his family own three apartments with an area of ​​45,5 sq.m., 65,6 sq.m., 13,5 sq.m.; a plot of land for growing vegetables and berries of 1000 sq.m., as well as a 2000 Toyota Camry.

The judge refused to provide an explanation about the origin of his property.

Judge Vadim Ivanchuk distinguished himself in the following cases.

While hearing the case against Dmitry Kravets, the son of Oleksandr Kravets, a Party of Regions member of the Odessa Regional Council who fatally struck a 27-year-old man and left his 27-year-old companion disabled in August 2009, Judge Ivanchuk made a paradoxical decision declaring the "rich kid" innocent and exonerating him from unfounded charges.

The court made this decision despite the fact that D. Kravets crashed into people on the roadway at a speed of 112 km/h, had repeatedly run afoul of the law (according to the victims' lawyer, the culprit of the accident is involved in sixteen criminal cases), was under investigation, and a year before the accident he had already been amnestied for the crime he committed (taking possession of a car by force).

The judge based his decision on the fact that D. Kravets admitted his guilt, committed the hit-and-run "unintentionally," and has minor children in his care.

Judge Ivanchuk advised the victims to file a civil suit demanding compensation for moral and material damages, since during the two-year investigation, D. Kravets had not paid a single penny to the families of his victims.

Judge V.N. Ivanchuk is also known for covering up fabricated criminal cases.

On March 24, 2014, in the Kyiv District Court of Odessa, guards severely beat three defendants, allegedly on the orders of Judge V.N. Ivanchuk. In protest, one of them cut his stomach.
The defendants claimed that "Judge Vadim Ivanchuk is covering up the fabrication of the criminal case and generally violating all legal norms. Specifically, he refuses to consider the defendants' motions. Furthermore, the judge expels journalists from court hearings without explanation, which in itself is a violation of the law."

Moreover, in March 2013, Judge V.N. Ivanchuk jailed a traffic enforcement activist for three days, citing a law that had been repealed. In other words, he deprived the man of his freedom of action without bothering to review the current version of the law.

The public organization "Rule of Law" filed a complaint about this to the High Qualifications Commission of Judges of Ukraine. The judge was even asked to provide an explanation, but he was never held accountable.

This is only a small part of what this judge does. Unfortunately, most of his decisions, of course, are not covered by the media. But even these decisions demonstrate that V.N. Ivanchuk is incapable of administering justice. What he does is a parody of justice.

The public organization "Rule of Law" appealed to the High Qualification Qualification Commission of Ukraine with a request to consider the issue of removing V.N. Ivanchuk from the position of judge.
