Judge Oleg Neporada of the Malinovsky District Court of Odessa is hearing a criminal case against N.V. Miserzhi, S.V. Dimitrov, V.V. Borovik and S.I. Veris for committing a crime under Part 4 of Article 185 (large-scale theft) of the Criminal Code of Ukraine.
As previously reported on this website, this case was sent for review back in 2012. However, for unknown reasons, the judge was reluctant to hold the perpetrators accountable. This prompted the public organization "Rule of Law" to file a complaint against the judge with the High Qualification Commission of Judges of Ukraine - https://verhovenstvo.com/view/8439.
As further information from the public has revealed, Irina Dmitrievna, the lawyer for one of the defendants, Arseniy, is equally ineffective in fulfilling her professional duties, as is the judge. This manifests itself in her failure to attend court hearings without good reason, leading to postponements of the case and, consequently, to a protracted trial.
Due to Judge Oleg Neporada's apparent leniency toward the lawyer's actions and failure to respond to his "absences," of which there are now more than 10, and in order to prevent similar "procedural sabotage" by the lawyer in the future, the public organization "Rule of Law" filed a complaint with the Qualification and Disciplinary Commission of the Bar Association regarding the lawyer's actions.
