The Ministry of Internal Affairs will seize documents from the Kyiv City State Administration necessary for conducting an investigation into the embezzlement of budget funds received by Kyiv as environmental investments under the Kyoto Protocol.
KV learned of this from a decision to request documents from Lieutenant Colonel Tatyana Kolotyhina, a senior investigator at the Main Investigative Directorate of the Ministry of Internal Affairs of Ukraine.
According to the document, officials of the state-owned enterprise GosEcoInvest, whose director was Mikhail Koblya, abused their official positions to benefit third parties, which led to grave consequences.
Specifically, the investigation established that in 2013-2014, employees of the state-owned enterprise, acting contrary to the service's interests, conducted 12 procurement procedures from Karpatystroyinvest LLC, Intertekhenergo LLC, Donetskteplokomunenergo OKP, Elios Strategy LLC, and others for a total of UAH 956,482,248.42, violating public procurement procedures and principles, specifically the principle of "fair competition." These actions caused losses to the state that exceeded the non-taxable minimum income of citizens by 250 times.
In addition to these violations, the investigation is examining facts of embezzlement of budget funds received from the implementation of targeted environmental (green) investment projects and proposals regarding the implementation of measures related to the fulfillment of obligations under the Kyoto Protocol.
During the pre-trial investigation, it became necessary to obtain the following documents from the Kyiv City State Administration:
documents that define the Kyiv City State Administration as the manager of budget funds received as green investments;
all procurement documents for the implementation of projects funded by green investments;
agreements concluded by the Kyiv City State Administration related to the management of budget funds received through environmental projects.
Previously, media reports indicated that a criminal investigation had been opened into the embezzlement of green investments. Specifically, in response to a request from MP Yuriy Derevyanko to the Main Directorate of the Ministry of Internal Affairs in Kyiv, police reported that "on June 20, 2014, the Investigative Department of the Main Directorate of the Ministry of Internal Affairs in Kyiv opened a criminal investigation with a preliminary legal classification of the offense under Part 5 of Article 191 (Misappropriation, embezzlement, or taking possession of property through abuse of office) of the Criminal Code of Ukraine, regarding the embezzlement and misappropriation of state budget funds by officials of the State Enterprise GosEkoInvest between 2012 and 2014."
In 2013, an audit was conducted at the state-owned enterprise, which revealed violations of the procurement procedure and determined that the former general director of the state-owned enterprise GosEcoInvest, Mikhail Koblya, had personally made the decision to conduct the procurement procedure from a single participant and held meetings with the participants in the procurement procedure before the creation of the competitive bidding committee.
