The court ordered Ukrgazvydobuvannya OJSC to repay UAH 214 million in loan debt not to the individual guarantors, but to the bankrupt Delta Bank. The Supreme Commercial Court issued this ruling on March 15, 2016.
It is known that in September 2013, Ukrgazvydobuvannya took out a UAH 150 million loan from Delta Bank, which was supposed to be repaid by the end of 2014. However, the bank's money was never repaid. On November 28, 2014, Delta Bank entered into surety agreements for the Ukrgazvydobuvannya loan with ten individuals who were depositors at the bank. Thus, the bank effectively transferred Ukrgazvydobuvannya's loan to these individuals. This occurred because Delta Bank ostensibly repaid the loan with funds from the guarantors, who held them in accounts at the same financial institution. In turn, the guarantors received the right to collect the loan from Ukrgazvydobuvannya.
In August 2015, Delta Bank obtained a court decision to recover UAH 214 million from Ukrgazvydobuvannya. However, in December 2015, the court of appeal dismissed Delta Bank's claim. The Supreme Commercial Court, however, overturned the appellate decision and upheld the first-instance decision. The court noted that the surety agreements violated the order of satisfaction of creditors' claims.
The list of 10 people to whom Delta Bank transferred Ukrgazvydobuvannya's debt included former member of the National Bank's supervisory board Oleksandr Bilanenko, the son of the former Minister of Justice Maksym Lavrynovych , the son of the former deputy head of the national bank Anatoly Shapovalov Igor Shapovalov, and the acting head and deputy chair of the board of Delta Bank Iryna Zayarnyuk.
