A prosecutor in the Odessa region was punished for negligence.

Vasyl Rusanzhyk, prosecutor of the Bolhrad District Prosecutor's Office in the Odessa region, was punished for improper performance of his official duties. The editorial board reported this. 368 media I learned the decision of the State Committee on Public Prosecutions.

Rusanzhik previously served as the first deputy head of the Izmail local prosecutor's office, and on March 15, 2021, he was transferred to the position of prosecutor in Bolgrad. A complaint was filed against him by the head of the regional prosecutor's office, Sergei Kostenko. Rusanzhik committed two errors. In February 2016, he notified a man of suspicion under Part 3 of Article 185 and Part 2 of Article 190 of the Criminal Code, and in March, the indictment was sent to the Izmail City and District Court.

Following a preparatory court hearing with Rusanzhik on May 12, the court returned the indictment to the prosecutor for correction of identified deficiencies due to its non-compliance with paragraphs 2 and 5, Part 2, Article 291 of the Criminal Procedure Code. Vasily Rusanzhik did not resubmit the indictment to the court, and, accordingly, the court did not hear the criminal case.

Rusanzhik also failed to properly perform his official duties in organizing procedural management of the criminal case against a man suspected of committing a crime under Part 1 of Article 309 of the Criminal Code. Specifically, after the notice of suspicion and the approval of the indictment on February 15, 2017, Prosecutor Rusanzhik failed to forward the criminal case materials to the Izmail City and District Court of Odessa Oblast.

In the complaint, the author points out the failure of V.P. Rusanzhik to fulfill his official duties for 7 years while exercising procedural leadership in another criminal proceeding, since the said materials, sent by the Rivne local prosecutor's office of the Rivne region to the Izmail inter-district prosecutor's office in December 2014, remained idle and were physically found in the possession of prosecutor Rusanzhik.

Thus, during the specified period, no pre-trial investigation was conducted in the aforementioned criminal proceedings, which resulted in a violation of Article 28 of the Criminal Procedure Code regarding the conduct of a pre-trial investigation within a reasonable time. The materials from these criminal proceedings were discovered on the premises of the Bolgrad District Prosecutor's Office.

Prosecutor Vasily Rusanzhik admitted that he had committed violations and noted that these violations were committed as a result of his heavy workload.

Specifically, he reported that in late 2018 or 2019 (he doesn't remember the exact date), the head of the Izmail local prosecutor's office summoned him and informed him that criminal proceedings had been discovered in his office. The head of the local prosecutor's office instructed him to transfer these materials to the Bolhrad branch of the Izmail local prosecutor's office for further archival storage. In December 2021, while reviewing a request from the Rivne Regional Prosecutor's Office, criminal proceedings were discovered in the archives of the Bolhrad District Prosecutor's Office.

The State Security Committee decided to hold prosecutor Rusanzhik accountable and impose a disciplinary sanction in the form of a reprimand.
