The Ministry of Justice is using corporate raiding methods and grossly violating the law at the Lermontovsky sanatorium.

Lermontovsky

The administration of the Lermontov Sanatorium in Odessa claims that the Ministry of Justice, to which the Cabinet of Ministers transferred the health resort's buildings, is using corporate raiding methods, grossly violating the law.
As Ilya Khaldai, the sanatorium's lawyer, told Dumskaya, the court's decision, which took Lermontovsky from Ukrprofzdravnitsa and transferred it to the State Property Fund, only concerns real estate.

"But the sanatorium also includes medical equipment and much more, which is not mentioned in the verdict. But they plan to take everything—on what basis is unclear. Furthermore, in reaching its decision, the court relied on an inventory of the property complex conducted in 2001. But since then, some buildings have been destroyed and others have been built—for example, we built a new boiler house. In total, Ukrprofzdravnytsia made improvements worth 10 million hryvnias. The commercial court ruling makes no mention of them," the legal expert says.
In fact, Khaldai says there were numerous violations during the transfer process. Specifically, the commercial court, while revoking the trade unions' ownership rights, failed to order the state to reclaim the property. This would require a separate court ruling, which does not exist. Consequently, the sanatorium complex was not registered with the state and, according to all documents, remains in the hands of Ukrprofzdravnytsia.

Tomorrow, the sanatorium staff intend to go to the regional justice department and demand that officials comply with the law.

It's worth noting that the Cabinet of Ministers' decree on the transfer of the Lermontovsky Sanatorium makes no mention of the categories of citizens currently using the health resort's services—members of all Ukrainian trade unions, socially vulnerable groups, and refugees from the east of the country. It applies only to employees of the Ministry of Justice and its subordinate agencies, such as the State Penitentiary and Executive Services. Prison guards instead of miners...

We are ready to give the floor to the other party to the conflict – the Ministry, the State Property Fund, and the Cabinet of Ministers.
