The Supreme Court dismissed the appeal of VOG Retail LLC against the court decisions upholding the Antimonopoly Committee of Ukraine's decision to fine the company for anticompetitive concerted actions in setting retail prices for light petroleum products in October 2016.

The press service of the Antimonopoly Committee reported this, writes EP.

"Since the Supreme Court's decision is final and not subject to appeal, VOG Retail must pay into the state budget not only the fine but also the penalty that accrued over the years and ultimately equaled the fine—UAH 54,036 million," the AMCU said in a statement.

In 2016, the Antimonopoly Committee of Ukraine fined several major gas station operators for violating laws protecting economic competition, specifically for anticompetitive concerted actions in setting retail prices for light petroleum products.

The committee proved that the companies had been coordinating the maintenance of similar retail prices for A-95 gasoline and diesel fuel on the information boards of their stationary filling stations.

The Committee also found that the participants in the concerted actions introduced "loyalty programs" that prevented consumers from receiving full information about the actual final retail price of fuel. This was due to their complex and opaque terms and conditions for promotions and discounts.

Previously, Alliance Holding LLC — Shell (UAH 39,711 million), AMIK Ukraine PE — Lukoil/AMIC (UAH 12,53 million), Parallel-M LTD LLC — Parallel (UAH 1,438 million), and SOCAR Petroleum/SOCAR (UAH 2,534 million) agreed to pay a fine plus a similar penalty for a six-year-old case for seven companies.

OKKO Oil Product Private Enterprise (OKKO) (UAH 77,881 million) and Zolotoy Ekvator LLC (WOG) (UAH 16,195 million) are still trying to appeal the fine.
