An internal investigation may be conducted against the First Deputy Chairman of the Board of the National Bank of Ukraine, Oleksandr Pysaruk, for illegally classifying ProFinbank as insolvent.
Vsevolod Volkov, a partner at the international law firm Integrites, which is supporting the bank in its dispute with the NBU, announced this at a press conference.
"If we succeed in challenging the National Bank's decision (declaring ProFinbank insolvent – ed.) in court and prove the illegality of Mr. Pisaruk's actions against ProFinbank, we will initiate an internal investigation at the National Bank," Volkov stated.
According to legal requirements, officials are suspended from their official duties during an official investigation.
"We want the regulator to reconsider the unlawful decision that led to the temporary administration of the bank. We know that the NBU's decision to declare the bank insolvent was made at night, under personal pressure from Mr. Pisaruk. We also know for certain that the heads of the NBU's legal department, supervision, and financial monitoring department opposed categorizing our bank as insolvent: the NBU recognized the dubious nature of such a move against ProFinbank. We can only guess at Mr. Pisaruk's motives for exerting such pressure," said Dmitry Fedoseyev, shareholder and head of the Supervisory Board of ProFinbank.
During the press conference, he repeatedly pointed out attempts to raid the bank, and also expressed suspicion that First Deputy Governor of the NBU Pysaruk was personally involved. Fedoseyev explained that representatives of the Deposit Guarantee Fund are already telling clients that they shouldn't worry about their money, as the bank will soon have a new owner. Therefore, according to the banker, the blocking of the financial institution's operations could be a paid scheme, with the NBU assisting the raiders.
"A temporary administration is being installed under a trumped-up pretext, completely blocking the bank's operations. During the days the temporary administrator has been working at the bank, we have been repeatedly approached by various people, citing senior NBU officials, offering to resolve our problems with the regulator. Last week, I received calls from people who unequivocally hinted at selling the bank. Therefore, our opinion is that the regulator's unlawful decision is part of a planned corporate raid," Fedoseyev explained.
At the same time, the National Bank ignores all appeals from the bank's owners and management and fails to explain the rationale behind its actions. Therefore, ProFinbank, with the support of the international law firm Integrites, is already challenging the National Bank's decision to classify it as insolvent in court.
The bank filed a lawsuit with the Kyiv District Administrative Court, demanding the annulment of the NBU's Resolution No. 35/BT of January 19, 2015, classifying ProFinbank as insolvent. The bank will also seek the removal of the temporary administrator, who is currently in place based on the NBU's dubious decision. However, client transactions are currently blocked, and depositors are unable to access their funds. In a separate motion, the lawyers ask the court to suspend the disputed NBU resolution in order to restore the financial institution's normal operations.
