Key facts from the criminal case against renowned banker Borys Timonkin have emerged: illegal loans from Brokbusinessbank to Real Bank totaling UAH 837 million, loans to fictitious enterprises owned by Serhiy Kurchenko totaling UAH 1,437 billion, fictitious transactions with the Agrarian Fund totaling UAH 2,069 billion, and fictitious transactions with Ukrgasbank totaling UAH 500 million. Information about the crimes committed by banker Borys Timonkin jointly with businessman Serhiy Kurchenko is set out in a ruling by Kyiv's Pechersky District Court dated August 18, 2015, the First Instance reports. By this ruling, the Kyiv court authorized an audit of Real Bank, through which, according to investigators, Kurchenko's team illegally laundered hundreds of millions of hryvnias.

Former Chairman of the Board of Ukrsotsbank, Borys Timonkin, joined Serhiy Kurchenko's team in July 2013, where he was responsible for VETEK's financial affairs and the operations of its banks. Specifically, in September 2013, he became a member of the supervisory board of Brokbusinessbank. After Yanukovych's team fled, he also left Ukraine, ostensibly for medical treatment. In May of last year, the Prosecutor General's Office placed him on the international wanted list. Timonkin is accused of document forgery and theft of state property on an especially large scale. In the summer of 2015, German police detained the banker, and his extradition to Ukraine is being considered.

Given the charges against Timonkin, nothing good awaits him here.

Thus, according to information from the Pechersk court, in 2013-2014, Timonkin "participated in a criminal organization created by Sergei Kurchenko to commit serious and especially serious crimes, and was a co-perpetrator."

 

According to investigators, two years ago, Kurchenko, with the assistance of Timonkin, acquired 80,0273% of the shares in the authorized capital of Brokbusinessbank (with a total par value of 2,02 billion hryvnias) “to ensure the illegal activities of a criminal organization.”

Ownership of the shares was formalized through the purchase and sale of securities by fictitious enterprises controlled by Kurchenko: “Eastern European Fuel and Energy Company”, “Aynam”, “Alkonost”, “Amadiny”, “Aminami”, “Alkon-torg”, “Muine” LLC, “Ultrastarinvest” LLC, “Khigan”.

Then, with Timonkin's direct involvement, the businessman replaced the bank's governing bodies—the supervisory board and the management board—by including his trusted confidants: the head of the supervisory board, Denis Bugai, and the chairman of the management board (probably referring to Igor Frantskevich, who served as chairman of the management board from October 8 to December 10, 2013). Boris Timonkin personally searched for candidates for management positions at the bank.

At an extraordinary meeting of shareholders on September 3, 2013, Timonkin was elected as a member of the supervisory board.

According to the investigation, despite the collegiality of the bank's management and its supervisory board, management was actually carried out by Boris Timonkin in agreement with Kurchenko, with the participation of the head of the supervisory board and the chairman of the board.

The court documents contain key accusations brought against Kurchenko's team.

“From August 2013 to February 2014, Boris Timonkin, together with Sergei Kurchenko and Denis Bugai, participated in the commission of serious and especially serious crimes as part of a criminal organization, namely:

— appropriation of funds from Brokbusinessbank in the amount of 837 million hryvnias, laundering of this money by Brokbusinessbank providing interbank loans in favor of Real Bank and illegal placement of funds by Brokbusinessbank in a correspondent account at Real Bank (Part 5 of Article 191, Part 3 of Article 209, Part 2 of Article 366 of the Criminal Code of Ukraine);

— embezzlement of funds from Brokbusinessbank in the amount of 1,437 billion hryvnias, and the laundering of this money by issuing loans to fictitious enterprises controlled by Sergei Kurchenko (Part 5 of Article 191, Part 3 of Article 209 of the Criminal Code of Ukraine);

— appropriation of funds from Ukrgasbank in the amount of 500 million hryvnias, legalization of this money by concluding fictitious contracts for the purchase and sale of securities - bonds of the State Mortgage Institution with Ukrgasbank (Part 5 of Article 191, Part 3 of Article 209 of the Criminal Code of Ukraine);

— the seizure of funds from the Agrarian Fund in the total amount of 2,069 billion hryvnias through the conclusion by Brokbusinessbank of fictitious contracts for the purchase and sale of domestic government loan bonds with the Agrarian Fund and direct repurchase agreements with the National Bank of Ukraine (Part 5 of Article 191, Part 3 of Article 209 of the Criminal Code of Ukraine).

On June 22, 2015, Timonkin was issued a notice of suspicion of committing the aforementioned offenses.

 

On August 18, the Pechersky District Court granted the Prosecutor General's Office's motion to conduct an unscheduled audit of Real Bank for the period from 2012 to the present. This data will be used as evidence in the criminal investigation.

Interbank transactions between Real Bank and Brokbusinessbank, as well as loans issued by Real Bank to a number of enterprises with signs of fictitiousness, etc., are subject to verification.

In 2013, over 4 billion hryvnias were transferred from Real Bank to the accounts of unknown companies.

The companies to which Real Bank issued dubious loans include:

Cherkassy-Gazsnab, Feshin-Mobile, Rayagrostroy-Perspektiva, Krimbutangaz, SK Gefest Alliance, Zaporizhzhia Koksokhimremont, Margolak, Donetsk-Pobutskrapgaz, Kharkivspetsgazsnab, Grant-Time, Donetskpobutgaz, Ukrenergorinok, Informtrest-consulting, Ukrkommertspostach, Chernivtsi-SPBT, SK Pervaya Chornomorskaya, Business-Consultant, Multi-Aqua, Progress Inside, Aristocrat TIM, Kyivmontazh, Amon-Sul, Kombiagroindastri, Kyivoblpropangaz, SMT TIME, Maestro Torg, NYuAZh, Noldor, Plavtu-SERVIS, "Invest-Tranche", "Business-Benefit", "Morgota".

Let us recall that at the time these crimes were committed, Boris Timonkin served as deputy chairman of the supervisory board of Ukrsotsbank and was actively involved in the distribution of Ukrsotsbank's cash flows, including cashing out the bank's funds under the guise of legal services.
