Kolomoisky's takeover of Ukrtatnafta: The US Supreme Court ordered Ukraine to pay $173 million to the Russians.

The US Supreme Court has rejected Ukraine's appeal in the case of the withholding of $173 million in favor of Russia's Tatneft, which concerns the company's loss of control over the Kremenchug oil refinery, according to reports. Letters.

Thus, the Supreme Court affirmed the decision of the lower US court to uphold the arbitration award.

Tatneft has been seeking enforcement of the ruling since 2017. Ukraine has argued that the case should not be heard in a U.S. court, adding that Tatneft has failed to prove that Ukraine has any assets in the United States, and therefore there are no grounds for pursuing the matter in the country. Tatneft has claimed that Ukrainian courts have proven unreliable and that arbitration is typically heard in U.S. courts.

In 2020, U.S. District Judge Colleen Kollar-Kotelly ruled in favor of Tatneft, and the U.S. Court of Appeals for the District of Columbia Circuit subsequently upheld the ruling in 2021. Ukrainian lawyers petitioned the U.S. Supreme Court to hear the case after Russia's February invasion, arguing that the legal battle should be conducted in Ukrainian courts.

Ukraine's lawyers have asked the US Supreme Court to hear the appeal, given Tatneft's ties to the Russian government. Ukraine claims Tatneft used the case to attack third parties integral to Ukraine's national security on the eve of a full-scale invasion.

Reuters noted that the US Justice Department has not yet resolved the case, but expressed concern that important Ukrainian documents shared with Tatneft could be passed on to the Russian government.

The case concerns the loss of control over the Kremenchug oil refinery by a Russian company.

Thus, in 1994, Ukrtatnafta was created on the basis of the Kremenchug Oil Refinery in accordance with decrees of the presidents of Ukraine and Tatarstan. Previously, 18,296% of Ukrtatnafta's shares were owned by entities close to Tatneft, while the Tatarstan Ministry of Property owned 28,7788%, and Tatneft owned another 8,6%.

Following a series of legal proceedings in Ukraine, some Tatarstan shareholders in the refinery were effectively wiped out. The company now has shareholders close to Igor Kolomoisky and Gennady Bogolyubov's Privat Group.

In 2014, the arbitration court ruled in favor of Tatneft and ordered Ukraine to pay the Russian company $112 million in compensation, plus interest. Ukraine also lost its appeal.

In June 2020, it was reported that the Ministry of Defense had signed a contract for the supply of aviation fuel with oligarch Igor Kolomoisky's company, Ukrtatnafta, which had bid the highest at the auction.

On September 13, Ukrzaliznytsia unveiled the only bid submitted by an inexperienced dealer for oligarch Igor Kolomoisky for a tender for spare parts for freight cars, with an expected value of 154,19 million hryvnia.

London's High Court has adjourned the hearing of PrivatBank's lawsuit against its former owners, businessman Igor Kolomoisky and his business partner. Gennady Bogolyubova, which was supposed to take place in June 2022. However, following a petition, the court postponed the hearing for a year.

Sergei Leshchenko, a non-staff adviser to the head of the Presidential Office, believes it would be better to hand over businessman Igor Kolomoisky to the United States, where he would be sentenced to prison, and the money would be transferred to Ukraine.
