The appellate court upheld the SAP prosecutor's appeal to overturn the court's decision to close the case regarding the loan from the state bank, writes Word and deed.

The Appellate Chamber of the Supreme Anti-Corruption Court overturned the closure of a criminal case regarding the embezzlement of a $20 million loan from Oschadbank by the agricultural holding company Kreativ, where the son and daughter of the deceased former people's deputy are among the defendants. The Supreme Anti-Corruption Court (HACC) made this decision on the evening of November 24, the court's press service reported.

«Following the trial, the panel of judges upheld the prosecution's appeal. The HACC ruling of August 22, 2022, was overturned, and a new ruling was issued denying the defendants' defense's motion to dismiss the criminal proceedings. The case materials must be sent to the HACC for consideration at the preparatory stage of the trial.", the court notes.

The decision entered into legal force from the moment of its announcement and is not subject to appeal in cassation.

As a reminder, the SAP closed two cases against former MP Berezkin in connection with his death. According to investigators, in 2013-2014, former MP Berezkin organized a criminal groupThe purpose of the scheme was to seize $20 million from Oschadbank, allocated to the agricultural holding company "Creative." At the time, the MP was the de facto controller of the company, and his son was a co-founder. According to investigators, after receiving the loan funds, secured by a grain elevator and a fictitious contract, they were immediately transferred to the accounts of the Swiss company CREATIV TRADING SA and the Belizean company Quadra Commodities SA Limited under contracts for the purchase and sale of tropical oils worth the specified amount.

However, the actual delivery never took place. Subsequently, $10 million was transferred to Quadra Commodities SA Limited at the Latvian bank ABLV Bank. After this, $7,64 million was transferred to the Cypriot offshore company Pricewaterhousecoopers Associates Ltd for the purchase by Quadra Commodities SA Limited of 100% of the shares of Barcosta Ventures Limited, which owns 97% of the shares of PJSC Chernomorgidrozhelezobeton. The remaining $2,32 million of the loan funds was transferred to another Belizean company, Titan LTD, to an account at a Latvian bank. According to the investigation, CREATIV TRADING SA, Quadra Commodities SA Limited, and TITAN LTD were controlled by the same group of individuals.

Berezkin also confirmed his investment in the purchase of the Chernomorgidrozhelezobeton plant during his testimony in the Supreme Court of Belize in 2015. According to law enforcement, Berezkin's son and daughter currently own a controlling stake in Chernomorgidrozhelezobeton.
